ORDER ADOPTING REPORT AND RECOMMENDATION

The magistrate judge to whom this matter was referred has recommended that the defendant's plea of guilty be accepted and entered as to Counts I, II, and III of the Indictment. On June 4, 2015, the parties appeared before the magistrate judge. At that time, the magistrate judge conducted a colloquy with the defendant, and the defendant entered his guilty plea. The magistrate judge entered her findings regarding the defendant's waiver of his rights and his decision to plead guilty in a Report and Recommendation ("R&R") (dkt. no. 44).
Having reviewed the magistrate judge's R&R and all other relevant filings, I approve and ADOPT the magistrate judge's recommendation in its entirety. The defendant's plea of guilty is therefore accepted and, on the basis thereof, I find the defendant GUILTY as to Counts I, II, and III of the Indictment.

REPORT AND RECOMMENDATION CONCERNING PLEA OF GUILTY

Defendant, by consent, has appeared before me pursuant to Rule 11 of the Federal Rules of Criminal Procedure and Rule 5 of the Rules for United States Magistrate Judges in the District of Massachusetts, and has entered a plea of guilty to Counts I, II, and HI of the Indictment. After cautioning and examining the Defendant under oath concerning each of the subjects mentioned in Rule 11, 1 determined that the guilty plea was knowledgeable and voluntary and that the offenses charged are supported by an independent basis in fact establishing each of the essential elements of such offenses. I therefore recommend that the plea of guilty be accepted and that Defendant be adjudged guilty and have a sentence imposed accordingly.
